Estate Planning

Estate planning is one of the necessities of life. Having an updated will where your assets will be dealt with in the manner you choose provides peace of mind. It is also important to have an enduring power of authority.

Assets held in joint names, assets held by trusts and companies, and superannuation benefits do not form part of a person's estate and are not governed by their will.

Some of the matters to consider include:

  • Who will be the executor?
  • Is a testamentary trust appropriate? If so, who will be the trustee?
  • Should a binding death benefit nomination be made regarding superannuation benefits?
  • To whom should any shares be transferred? Are there any unrealised capital gains, or losses?
  • Who is to become the trustee and appointor of any trusts?
  • Depending upon whose name a main residence is held in, should a right of occupancy be included in the will?
  • Who will be guardian of children under the age of 18?
  • Should the will include an equalisation clause?
  • Are there any specific bequests to be made?

The executor and trustee of a will are required to perform a number of duties.

We can discuss the tax implications of estate planning issues, the control of companies/trusts and provide referrals for wills and testamentary trusts.
